Section 165: Offence to inadequately supervise children of the Education and Care Services National Law Act 2010, it is an offence to inadequately supervise children. Inadequate supervision is currently the most commonly breached section of the National Law (section 165) in Australia.
But inadequate supervision can have far more serious consequences than just monetary fines and the potential loss of your employment. It can result in serious injury or the death of a child.
What is active supervision?
• It is the basis of providing a positive education and care experience.
• Protects children from harms or hazards that occur in daily experiences in play
• Allows for immediate response to a child who is distressed or in a hazardous situation.
